The name of freedom of expression is the basic right of every subject to be
freely manifest, express their opinions and beliefs, receive ideas and information, by
means of oral or written language, the artistic environment, as well as any other means of
communication, regardless of license or censorship. The right to freedom of expression is
guaranteed in article 5, item IV, of the Brazilian Federal Constitution, and in its terms
states that “the manifestation of thought is free, anonymity being prohibited”. the item

In the search for a balance of values, State Deputy Luiza Maia (PT) created the
bill (PL) 19,237/11 which was approved by the Legislative Assembly of Bahia,
becoming State Law No. 12537/2012. The text of this law prohibits contracting with
public funds of artists who have, in their repertoires, songs with offensive content
