The name of freedom of expression is the basic right of every subject to be

freely manifest, express their opinions and beliefs, receive ideas and information, by

means of oral or written language, the artistic environment, as well as any other means of

communication, regardless of license or censorship. The right to freedom of expression is

guaranteed in article 5, item IV, of the Brazilian Federal Constitution, and in its terms

states that “the manifestation of thought is free, anonymity being prohibited”. the item

IX, of that same article, adds: “the expression of intellectual, artistic activity is free,

scientific, regardless of censorship or license”.

The declaration of the right to liberty provided for in article 5 of the Federal Constitution

Brazilian is not absolute, it is limited, just note that item IV of this article declares the

free expression of thought, however prohibits anonymity, and further on, item X,

imposes responsibilities on those who violate the intimacy, honor or image of others.

In view of the above, a consideration will be made, if necessary, to the excesses of freedom

to women or gays, or who incite any form of violence. This Law is already in force in Bahia
