Mining and Quarrying in the Democratic Republic of Congo:
Rights, Obligations and Protection of Investors

Ten years ago, the Democratic Republic of Congo (DRC) adopted a new mining code
under
Law nº007/2002 of 11 July 2002 (the "Mining Code") with a view to attracting
investments and turning its considerable natural resources into wealth. Since 2013, the
DRC has announced that
the Mining Code is shortly to be revised in order to remedy its deficiencies.

The main legislation in the Democratic Republic ofCongo (DRC] dealing with mining
industry is the Mining Code (adopted in 2002 and currently under revision) and the
ancillary Mining
Regulation, adopted in 2003. This legislatureis in general application throughout the entire
country.

Now, more than ten years later, the process to amend the DRC's Mining Code, is fully
underway
and this development has been one ofthe mining industry's focal points of discussion
since
2013. While nothing has been decided yet and negotiations are still ongoing, several
ofthe
government's amendment proposals have causedan adverse reaction from private
investors in the mining industry,
