Abstract: This article addresses the right to life, while the Fundamental Law with connection to voluntary abortion until the third month of gestation. The right to life is the tutelage law older than the Fundamental Rights theory itself. Considering the Brazilian Legislation and doctrinators, starting from the fundamental rights until the Brazilian Civil and Penal Code. Beginning with the Fundamental Law expressed in article 5 of the Federal Constitution of 1988, the main objective is to establish the connection between Decree 678/1992 and has status of constitutional norm, the terms of art. 2 of the Brazilian Civil Code of 2002, where it safeguards, from conception, the rights of the unborn child, and to end the punishment for the illegal abortion practice that is in the Brazilian Penal Code (articles 124, 125 and 126) which expresses Protecting the life of the unborn child as a person in relation to the crime of abortion. On the perspective of reducing the deaths of both the pregnant and the fetus and another on the punishment of crimes committed by illegal abortion. This study also intends to present a history about the beginning of human conception, besides describing in which cases abortion is legal according to the Brazilian Law, record the psychic damages caused and the injuries that abortion can cause in the woman's body. The qualitative method is adopted, through a bibliographical research for analysis, understanding and legal interpretation on the subject, with the aid of legal texts and doctrines on the subject.
